1. Introduction
Welcome to EM2MEDIA (“we,” “our,” or “us”).
By purchasing our services or using our website, you agree to these Terms of Service. If you do not agree, please do not use our services.
2. Services
EM2MEDIA provides digital marketing services, including but not limited to:
- Meta (Facebook & Instagram) advertising
- Creative production (ad visuals/banners)
- Strategy and campaign setup
- Campaign management and optimization
- AI-based tools and reporting platform
All services are provided on a best-effort basis.
3. No Guarantee of Results
We do not guarantee specific results, including but not limited to:
- Revenue
- Leads
- Return on ad spend (ROAS)
Advertising performance depends on many factors outside our control, including market conditions, product quality, pricing, and competition.
4. Setup Fee
A one-time setup fee (typically $150–$300) is required before services begin.
This fee covers:
- Strategy development
- Campaign setup
- Creative preparation
- Platform onboarding
Important:
The setup fee is non-refundable, as work begins immediately after payment.
5. Monthly Services
After the setup phase, ongoing services are offered on a monthly basis.
Monthly services may include:
- Campaign optimization
- Creative testing
- Performance monitoring
- AI platform access
Clients may choose to continue or discontinue services after the setup phase.
6. Payments
All payments are due in advance and processed through third-party providers such as Stripe.
Failure to make payment may result in:
- Suspension of services
- Termination of access to the platform
7. Refund Policy
Due to the nature of digital marketing services:
- Setup fees are non-refundable
- Monthly fees are non-refundable once work has begun
We do not offer refunds based on campaign performance.
8. Client Responsibilities
Clients agree to:
- Provide accurate and complete information
- Grant necessary access to ad accounts and assets
- Respond in a timely manner when required
Clients are responsible for:
- Their product/service quality
- Fulfillment and customer experience
- Ad spend budgets
9. Ad Accounts & Ownership
Whenever possible:
- Clients retain ownership of their ad accounts
We are not responsible for:
- Account bans or restrictions imposed by Meta
- Platform policy violations
10. AI Platform Access
Clients may receive access to our internal platform.
This includes:
- Performance dashboards
- Reports and insights
- AI assistant features
Access is granted only during an active service period and may be revoked upon termination.
11. Limitation of Liability
To the fullest extent permitted by law:
EM2MEDIA shall not be liable for:
- Loss of revenue or profits
- Advertising losses
- Indirect or consequential damages
All services are provided “as is” without warranties of any kind.
12. Termination
Either party may terminate the working relationship at any time.
Upon termination:
- Services will stop
- Platform access may be revoked
- No refunds will be issued for completed work
13. Modifications
We reserve the right to update or modify these Terms at any time.
Continued use of our services constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Bulgaria.
